Welcome to RiverShare. By accessing or using our services, you agree to comply with the following Terms and Conditions. Please read them carefully, as they govern your use of our services.
1. Scope of Services
RiverShare provides local advertising services to businesses in Calgary, Alberta, Canada. Our services include design, printing, mail preparation, transportation, and delivery of advertising materials (e.g., postcards).
2. User Responsibilities
By engaging RiverShare's services, users agree to provide accurate information and comply with the terms outlined herein. Users are responsible for ensuring that advertising materials comply with all applicable laws and regulations. RiverShare reserves the right to refuse service for any materials deemed inappropriate or unlawful.
3. Payment Terms
Payments are collected after registration. Due to the costs involved in preparing and delivering advertising campaigns, refunds are not offered after payments have been collected.
Refund Policy: If postcards are damaged or not delivered, RiverShare will provide an immediate refund or allow users to roll over their payment to the next month's mailing. This ensures peace of mind for all participants.
4. Privacy and Data Protection
RiverShare values your privacy. We do not sell or share business information with third parties. All information provided by our clients is securely stored and used solely for the purpose of delivering our services.
5. Limitations of Liability
RiverShare strives to provide a seamless service but cannot guarantee the delivery of advertising materials due to circumstances beyond our control, such as delays or issues arising with third-party services (e.g., Canada Post).
RiverShare shall not be held liable for indirect, incidental, or consequential damages, including but not limited to lost revenue, profits, or business opportunities arising from service disruptions or delays.
6. Governing Law
These Terms and Conditions shall be governed and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law principles.
7. Dispute Resolution
In the event of a dispute, the parties agree to attempt to resolve the matter through good-faith negotiations. If a resolution cannot be reached, disputes shall be resolved through mediation or arbitration in Alberta before pursuing legal action.
8. Third-Party Limitations
RiverShare utilizes third-party services, such as Canada Post, for mail delivery. While we strive for seamless service, delays or issues with third-party providers may occur. In such instances, RiverShare will promptly communicate with all businesses regarding any delays in shipping.
9. Ad Design Approval and Liability
If RiverShare is responsible for designing the advertisement, a final proof will be sent to the participating business’s designated point of contact for review and written approval prior to printing. It is the responsibility of the business to carefully review all elements of the design, including but not limited to text, images, contact information, logos, and brand colours.
By providing written approval, the business confirms that all information is accurate and final. RiverShare will not be held liable for any errors, omissions, or inaccuracies in the ad content that were not identified and communicated prior to approval. Once the postcards are printed, no reprints or corrections will be possible.
